EU will not reconsider ECJ role in NI Protocol – report
The European Commission told member states that the role of the European Court of Justice (ECJ) in the Northern Ireland Protocol “is not up for discussion,” RTE reported on Friday. Meanwhile, the United Kingdom insists on an independent arbitration mechanism as one of the most important changes to the protocol.
According to a document seen by RTE, the Commission stated the protocol “outsources the management of the EU’s external border to the UK and that as such London is applying EU law as it relates to the European single market.” It argued it is therefore necessary that the ECJ play a role in “all matters of interpretation and application” of relevant EU laws. The Commission also pointed out Northern Ireland businesses have not objected to the role of the ECJ.
